What Are the New Rules for Dependant Visas in the UK 2024?
A dependant visa is a type of visa that allows immediate family members of holders to come to the UK from overseas. There are several different types of visas that allow the holders to bring dependant family members to the UK. This includes study, work, business and ancestry visas. This article will detail the new rules for dependant visas in the UK 2024.
New Immigration Rules
Beginning in January 2024, new immigration rules came into force. This means international students are no longer permitted to bring dependants into the UK. Only students who are engaged in PhD studies or postgraduate research programmes can bring dependants overseas.
From 11th March 2024, care workers and senior care workers were also no longer permitted to bring dependants.
What is a Dependant?
A dependant refers to either a partner, spouse or a child of the main visa holder. Partners must be married, in a civil partnership with the main visa holder, or have been living together for two or more years.
For a child dependant visa, the child must be under 18. If they’re 16 or older, they must be dependent on the main visa holder. This includes:
- If they aren’t living an independent life (not married, in a civil partnership or have any children)
- If they live with the main visa holder (unless they attend boarding school or university)
- If they’re financially supported by the main visa holder
How to Apply for a Dependant Visa
If you are dependent on a person who has an eligible UK work, student, business or ancestry visa, you can apply for a dependant visa. If you’re unsure of your eligibility, it’s recommended to consult a lawyer. At Caversham, we offer clear, concise immigration advice.
As an alternative to dependant visas for children and partners, close family members can be brought to the UK if the UK resident has indefinite leave to remain (IRL) or UK citizenship and meet Adult Dependant Relative visa requirements.
