What is an Uncontested Divorce?

This is in contrast to a contested divorce, where one or both parties disagree on these matters which leads to complication and delayed timelines.

The Process of an Uncontested Divorce

The process for an uncontested divorce is usually straightforward:

  1. One spouse files a divorce petition with the court outlining the grounds for divorce and confirming that both parties agree on said terms.
  2. The other spouse has to acknowledge receipt of the petition confirming that they agree to the divorce.
  3. Both parties must reach a division of assets agreement, child custody agreement and financial matters agreement. This can be done through a separation agreement or by negotiating directly with the help of a solicitor.
  4. Once the court receives all of the required documents and everybody is in agreement, the court will issue a Decree Nisi which confirms that the divorce can proceed.
  5. After a waiting period of around six weeks and one day, the court will issue a Decree Absolute which legally ends the marriage.

How Long Does an Uncontested Divorce Take?

As an uncontested divorce is quicker than a contested one, it can take as little as four to six months for the process to be completed. Of course, the timeline for divorce can vary depending on the complexity of the financial arrangement and whether any issues arise regarding children.
